About Us At AirAdvisor, we are dedicated to ensuring air travelers receive the compensation they are entitled to for flight disruptions. We operate a service for baggage claims for lost, delayed, and/or destroyed luggage and are present in the EU, UK, and other international markets, focusing on protecting air passenger rights globally. We have processed over 500,000 claims for clients from 221 countries, with a 4.7-star rating from 25,550 reviews. We operate in 21 languages (with 9 more forthcoming this year) and aim to reach 1 million claims by the end of 2026. Role We are seeking a highly skilled and dedicated Litigation Lawyer specializing in consumer flight claims (typically via small claims procedure) to lead in-court collections, owning or opening a boutique Legal Firm in Italy. Pre-court collections are managed by a team of paralegals. You will file batches of court cases to recover compensation and/or reimbursement of Out-of-Pocket Expenses (OPE) incurred by passengers and/or recover ticket refunds. AirAdvisor handles three types of airline claims: EU261 compensation for delays, cancellations, and denied boarding; and three types of baggage claims under the Montreal Convention: lost, delayed, and/or destroyed luggage. If the law or a judge decides the case unfairly, we would consider escalating to change the law where feasible. There may be PR opportunities regarding court victories and essential legal issues. This is an excellent opportunity for high performers who can self-perform, have strong litigation experience, and are passionate about advocating consumer rights in the airline industry. The candidate must be free from conflicts of interest, i.e., be free to litigate claims against different airlines. Requirements A valid Attorney at Law license in Italy and professional liability insurance. A law degree from an accredited institution. Experience with small claims, consumer rights, or aviation law is a plus but not required. Knowledge of relevant consumer protection laws and aviation regulations is a plus but not required. Proven track record of success in in-court collection. Strong analytical and problem-solving skills to assess case merits, conduct legal research, and develop effective legal strategies. Ability to manage a caseload, prioritize tasks, meet deadlines, and track statute of limitations. Experience in automating and standardizing claims management processes to scale quickly. Responsibilities Act as the legal representative of AirAdvisor in Italy, handling all legal matters and claims filed within the jurisdiction. If setting up a law firm in Italy is feasible, assist in this matter, including corporate structuring and related formalities. Pre-court collections and out-of-court settlements. Prepare and file batches of approximately 200 new claims monthly in Italian courts against various airlines to recover: a) Compensation under EU Regulation 261/2004 and/or Turkish SHY Regulation for delays, cancellations, and denied boarding. b) Reimbursement of out-of-pocket expenses incurred by passengers under EU261/2004 and/or the Montreal Convention. c) Ticket refunds owed to passengers under applicable legal frameworks. d) Baggage-related claims, including delayed, damaged, or lost luggage, under the Montreal/ Warsaw Conventions. Respond comprehensively and assertively to airline legal defenses, including substantive and procedural/jurisdictional challenges. Lead the enforcement of court judgments, including initiating enforcement proceedings and coordinating with bailiffs or enforcement authorities when necessary. Engage in court-led settlement negotiations and represent AirAdvisor’s interests in securing favorable in-court settlements where applicable. Maintain complete and accurate legal case files, ensuring compliance with Italian legal ethics, data protection regulations, and professional standards. Conduct thorough legal research and analysis to identify best practices for managing recurring issues in airline and consumer rights litigation. Stay informed about developments in consumer protection law, aviation regulations, EU regulations, and judicial precedents to provide updated legal guidance. Where applicable, pursue legal remedies including appeals and advocate for legislative changes if strategically feasible. Support optimization and automation of claims management workflows using legal technology, including AI-based tools, to improve efficiency and scalability. Identify and propose new civil claims opportunities viable under Italian law, focusing on low-value, high-volume litigation potential. Areas may include bank/financial disputes and labor law-related claims, among others. Conduct cross-jurisdictional legal research across EU/UK markets to adapt precedents for Italy in complex scenarios. Represent AirAdvisor in local media and coordinate with the PR Manager to highlight landmark rulings and legal developments to boost public awareness of consumer rights. Review and vet content as needed to support local trust and authority. Advocate for passenger and consumer rights within the airline and travel industry.
