We are seeking a highly skilled and dedicated Litigation Lawyer specializing in consumer flight claims (typically via small claims procedure) to lead in-court collections. You may own or want to open your own boutique legal firm in Italy. Pre-court collections are managed by a team of paralegals. You will be responsible for filing batches of court cases to recover compensation and/or reimbursement of Out-of-Pocket Expenses (OPE) incurred by passengers and/or recover ticket refunds. AirAdvisor currently handles three types of airline claims: EU261 compensation for flight delays, cancellations, and denied boarding, and baggage claims under the Montreal Convention: lost, delayed, and/or destroyed luggage. Responsibilities Act as the legal representative of AirAdvisor in Italy, handling all legal matters and claims filed within the jurisdiction. Prepare and file batches of 200 new claims monthly in Italian courts against various airlines to recover (a) compensation under EU Regulation 261/2004 and/or Turkish SHY Regulation for flight delays, cancellations, and denied boarding; (b) reimbursement of out-of-pocket expenses incurred by passengers under EU261/2004 and/or the Montreal Convention; (c) ticket refunds owed to passengers under applicable legal frameworks; (d) handle baggage-related claims in accordance with the Montreal and/or Warsaw Conventions. Lead enforcement of court judgments and coordinate with bailiffs or enforcement authorities when necessary. Engage in court-led settlement negotiations and represent AirAdvisor’s interests in favorable in-court settlements. Support optimization and automation of claims management workflows, leveraging legal technology solutions, including AI-based tools, to scale operations. Provide cross-jurisdictional legal research across EU and UK markets to adapt precedents for Italy. Stay informed on developments in consumer protection law, aviation regulations, EU regulations, and judicial precedents to provide updated legal advice and representation. Assist in setting up a law firm in Italy if feasible, including corporate structuring and related formalities. Review and vet content as needed to build local trust and boost authority as in-country content reviewer of record. Requirements A valid Attorney at Law license in Italy and professional liability insurance. A law degree from an accredited institution. Experience with small claims, consumer rights, or aviation law is a plus but not required. Knowledge of relevant consumer protection laws and aviation regulations is a plus but not required. Proven track record of success in in-court collection. Strong analytical and problem-solving skills to assess case merits, conduct legal research, and develop effective legal strategies. Ability to manage a caseload, prioritize tasks, meet deadlines, and track statute of limitations. Experience in automating and standardizing claims management processes to scale quickly. Free from conflicts of interest and able to litigate against different airlines.
